Terms and Conditions

Status: Draft | Effective date: Pending owner approval

Purpose: Governs buyer and seller access to Bazaraw and explains Bazaraw's role as a marketplace platform.

1. Operator and acceptance

Bazaraw is a marketplace brand operated by ANURAG A, an individual, from Aditya Layout, RR Nagar, 560098 (collectively, "Bazaraw", "we", "us" or "our"). Bazaraw is currently not a separately registered legal entity.

These Terms apply to the Bazaraw website, applications, checkout and related services (the "Platform"). By creating an account, listing a product, placing an order or otherwise using the Platform, you agree to these Terms and the policies linked from them. If you do not agree, do not use the Platform.

2. Marketplace role

Bazaraw provides technology for independent sellers to display and sell products to buyers. Each product page should identify the seller responsible for that product. For a third-party product, the identified seller - not Bazaraw - is the supplier and is responsible for the product, listing accuracy, legal compliance, packaging, dispatch, delivery, cancellation decisions, returns, product refunds, warranty and after-sales obligations.

If a product page identifies Bazaraw as the seller, Bazaraw is the supplier for that product and the Bazaraw team is responsible for its fulfilment, shipping, cancellations, returns, refunds, warranty and after-sales obligations.

For third-party products, Bazaraw's role is limited to providing the marketplace, transmitting order or support information, facilitating checkout and payment processing, coordinating payment-provider settlement or refund execution where required, and addressing platform or grievance matters. These activities do not transfer the seller's fulfilment or product-refund responsibility to Bazaraw, except where applicable law requires otherwise or the issue was caused by Bazaraw's own platform or payment operations.

3. Eligibility and accounts

Users must be at least 18 years old and legally capable of entering a contract. Users must provide accurate information, protect login credentials and promptly update contact or account information. You are responsible for activity performed through your account unless you promptly notify Bazaraw of unauthorized access.

Bazaraw may verify buyers or sellers, request supporting documents, restrict features or suspend an account where reasonably necessary for security, legal compliance, fraud prevention, policy enforcement or investigation.

4. Product information and pricing

Sellers provide product descriptions, images, availability, variants, prices, taxes, warranty details, country-of-origin or importer information where applicable, shipping charges and return eligibility. Sellers must ensure this information is complete, accurate and not misleading.

The checkout page will show the product price, applicable shipping charges, the Bazaraw platform fee and other disclosed charges before the buyer confirms payment. Product availability is not guaranteed until the order is accepted and payment is successfully confirmed.

5. Orders and platform fee

An order request is subject to payment confirmation, product availability and seller acceptance. The responsible seller may cancel where the product is unavailable, the listing is incorrect, delivery is not serviceable or fulfilment is not legally possible. Bazaraw may cancel or block a transaction for payment or address-verification failure, suspected fraud or abuse, legal or regulatory requirements, or a Bazaraw platform-side error; this does not transfer the seller's ordinary fulfilment responsibility to Bazaraw.

Bazaraw currently charges buyers a fixed INR 11 platform fee per order, added to the product price. The amount is shown before payment. Once an order is successfully placed, the platform fee is generally non-refundable for buyer-requested cancellations, seller-side cancellations and product returns because the marketplace and payment-facilitation service has been used. It is refunded where the order or return results from a fault in a Bazaraw-sold product or Bazaraw's own platform or payment operations, and wherever applicable law requires a refund. Bazaraw may change the fee for future orders by clearly displaying the changed fee before checkout; a change will not apply retrospectively to a completed order.

6. Payments and Easy Split

The configured payment provider processes supported online payment methods. When split settlement is enabled and configured for Bazaraw, the product amount is intended to be allocated for settlement to the seller's verified bank account, while the platform fee is intended to be allocated to Bazaraw. Actual gateway deductions, settlement timing, holds, refunds and split behavior are governed by the provider's approved merchant configuration and agreement.

The payment-processing relationship is held by ANURAG A trading as Bazaraw. Buyers must not share a UPI PIN, card PIN, CVV, OTP or banking password with Bazaraw, a seller or any person claiming to provide support.

7. Shipping, cancellation, returns and refunds

For a third-party product, the respective seller manages packing, shipping, cancellations, returns, replacements and product refunds. Accepted orders should be dispatched within 2 business days. Delivery is usually estimated at 3-7 business days after dispatch, but location, courier availability, serviceability, weather, public holidays and other events may affect delivery.

A buyer may request cancellation from the respective seller before dispatch. For third-party products, change-of-mind return availability, the request window and product conditions are set by the respective seller and must be shown on the store page or product details before purchase. Some stores or products may not offer change-of-mind returns. These restrictions do not remove remedies that cannot lawfully be excluded for defective, deficient, unsafe, counterfeit, wrong, missing or materially misdescribed products. Bazaraw may provide the technical support channel and facilitate payment reversal through the payment provider after the seller approves a refund, but the respective seller remains responsible for the decision, fulfilment action, product refund and seller-attributable costs.

Where a product page identifies Bazaraw as the seller, the Bazaraw team handles shipping, cancellations, returns and refunds for that product. Detailed rules, exclusions, cost allocation and refund treatment appear in the Cancellation, Return and Refund Policy and Shipping and Delivery Policy, which form part of these Terms.

8. User and seller conduct

Users must not use the Platform to commit fraud, impersonate another person, interfere with Platform security, scrape or reverse engineer restricted parts of the service, upload malware, manipulate ratings or transactions, bypass fees, harass others, or violate any law or third-party right.

Sellers must not list illegal, counterfeit, unsafe, recalled, stolen, infringing, misleading or prohibited products. Bazaraw may remove listings, hold transactions, cancel orders or suspend access where reasonably necessary, without limiting any right available under law.

9. Intellectual property and user content

Bazaraw's name, brand assets, interface, software and original content are protected by applicable intellectual-property laws. Users may not copy, sell or commercially exploit them without permission.

A seller retains ownership of product content supplied by that seller but grants Bazaraw a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt for display and use that content to operate and promote the listing and Platform. The seller confirms it has the necessary rights to grant this licence.

10. Disclaimers and liability

The Platform is provided on an as-available basis. Bazaraw does not guarantee uninterrupted operation, that every seller will perform perfectly, or that every product will meet a buyer's subjective expectations. Nothing in these Terms excludes warranties, remedies or liabilities that cannot legally be excluded.

To the extent permitted by law, Bazaraw is not responsible for indirect or consequential loss arising solely from a seller's product or conduct. Bazaraw remains responsible for its own obligations and for remedies that applicable consumer law requires. Buyers retain all non-waivable statutory rights.

11. Suspension, termination and changes

Bazaraw may suspend or terminate access for material policy breach, fraud, illegal conduct, security risk, repeated fulfilment failure or non-cooperation with a lawful investigation. Where appropriate, Bazaraw may provide notice and an opportunity to respond.

Bazaraw may update these Terms for legal, operational or service changes. The current version and effective date will be published on the Platform. Material changes will apply prospectively unless law requires otherwise.

Bazaraw may modify the Platform's design, functionality, categories, recommendations and product-discovery experience at its discretion to operate, maintain and improve the Platform.

12. Governing law and contact

These Terms are governed by the laws of India. Subject to mandatory consumer rights and any forum available under applicable law, disputes will be subject to courts of competent jurisdiction in Kannur, Kerala.
